Responsibilities

Your Role:

The Corporate Counsel – Claims and Litigation will be responsible for managing the company’s claims and litigation portfolio, with a particular focus on property damage, auto liability, and workers' compensation claims. The successful candidate will work closely with internal stakeholders, external counsel, and insurance carriers to ensure that claims are resolved efficiently, legally, and cost-effectively.

  • Oversee and manage all aspects of litigation related to property damage, auto liability, and workers' compensation claims, including strategy development, settlement discussions, trial preparation, and resolution.
  • Supervise and guide internal claims adjusters to ensure timely and efficient processing of claims. Provide mentorship and training on claims handling best practices.
  • Monitor and manage claims to ensure they are handled promptly and in accordance with company policies. Work with third-party claims administrators and insurers to ensure proper handling.
  • Provide legal counsel on claims, insurance coverage, risk management, and other related areas. Work with senior leadership, including the General Counsel, to develop strategies for managing risk and minimizing liabilities.
  • Ensure the company complies with all relevant laws and regulations governing workers' compensation, auto liability, and property damage. Stay informed of legal and regulatory developments and advise on their impact.
  • Lead and manage settlement negotiations, ensuring fair and equitable outcomes while protecting the company’s best interests.
  • Assist with managing the company’s risk management insurance portfolio, ensuring adequate coverage across property, auto, and workers' compensation. Collaborate with the insurance department and brokers to assess needs and ensure optimal insurance strategies.
  • Manage pre-litigation claims and resolve disputes through alternative dispute resolution mechanisms, including mediation and arbitration, where applicable.
  • Develop and deliver training programs for staff and internal claims adjusters on best practices in claims handling, litigation avoidance, and risk management. Assist in the development and enforcement of corporate policies related to claims, litigation, and risk management.
  • Work with external counsel on complex litigation, ensuring effective case management and strategic decision-making to achieve the desired outcome.
  • Maintain accurate and thorough records of all claims and litigation matters, preparing regular reports for the General Counsel and senior management on the status and financial impact of ongoing cases. Assist with reporting on the company's insurance portfolio and risk management efforts.

Qualifications

What We’re Looking For:

  • Juris Doctor (JD) degree from an accredited law school and active membership in the Florida bar
  • Minimum of 5-7 years of legal experience, with a focus on handling claims and managing litigation related to property damage, auto liability, and workers' compensation.
  • Strong knowledge of relevant legal principles and regulations in workers' compensation, auto liability, and property damage.
  • Proven ability to independently manage complex litigation cases, including negotiating settlements.
  • Excellent analytical, problem-solving, and negotiation skills.
  • Strong written and verbal communication skills, with the ability to explain complex legal concepts to non-legal stakeholders.
  • Experience working with insurance policies, claims adjusters, and external legal counsel.
  • Demonstrated ability to collaborate effectively across departments and with external partners.
  • Experience in risk management and policy development is preferred.
  • Ability to work independently while managing multiple priorities in a fast-paced environment.
